Osoby prowadzące działalność gospodarczą, które podróżują służbowo do innych krajów UE, mogą ubiegać się o zwrot podatku od wartości dodanej – VAT. O zwrot należy wystąpić w Polsce według szczególnej procedury VAT-Refund, czyli wypełniając wniosek o zwrot podatku od wartości dodanej (VAT) naliczonego w innym państwie członkowskim.
Kto może skorzystać ze zwrotu podatku ?
O zwrot zagranicznego podatku VAT mogą ubiegać się przedsiębiorcy, którzy nie mają siedziby lub nie prowadzą działalności gospodarczej w kraju UE, w którym dokonali nabycia. Co więcej, dany kraj nie może być też miejscem ich stałego lub tymczasowego pobytu, musi być też czynnym
podatnikiem podatku VAT.
Terminy składania deklaracji
Wniosek o zwrot zagranicznego podatku VAT można składać najpóźniej do 30 września roku następnego po roku, w którym ponieśliśmy dany wydatek. Należy przy tym mieć na uwadze, że może on być złożony za okres minimum 3 miesięcy, a maksymalnie za okres 12 miesięcy.
Gdzie i w jakiej formie należy złożyć wniosek o zwrot VAT ?
Wniosek o zwrot zagranicznego podatku VAT należy złożyć drogą elektroniczną poprzez e-Deklarację, która dostępna jest na stronie internetowej Ministerstwa Finansów. W tym celu należy wypełnić interaktywny formularz VAT-REF, a następnie wysłać go za pośrednictwem e-Dekaracji. Po wysyłce uzyskuje się urzędowe Poświadczenie Odbioru (UPO). Warto również wspomnieć, że o zwrot podatku można też ubiegać się za pośrednictwem pełnomocnika (reprezentanta).
Ile trwa samo rozpatrzenie wniosku i wypłata ?
W chwili otrzymaniu wniosku VAT-REF polski urząd skarbowy sprawdza go pod względem formalnym. Jeśli dopilnowaliśmy wszystkich formalności, a wniosek będzie w porządku, to zostanie przekazany w ciągu 15 dni od daty otrzymania do zagranicznego urzędu skarbowego, w którym dokonaliśmy zakupu towaru lub usług.
Następnie to zagraniczny urząd skarbowy zajmie się jego analizą i w terminie od 4 do 8 miesięcy od dnia otrzymania wniosku o zwrot VAT prześle do polskiego podatnika swoją decyzję. W przypadku pozytywnego rozpatrzenia wniosku o zwrot podatku VAT na wypłatę trzeba będzie poczekać do 10 dni roboczych od upływu terminu, o którym mowa w art. 19 ust. 2 Dyrektywy RADY 2008/9/WE z dnia 12 lutego 2008 r. określająca szczegółowe zasady zwrotu podatku od wartości dodanej, przewidzianego w dyrektywie 2006/112/WE, podatnikom niemającym siedziby w państwie członkowskim zwrotu, lecz mającym siedzibę w innym państwie członkowskim.
